Loophole?
I don't like laws that track customer information.
Portland City Code 14B.85 was "written and passed with the intent to control access to spray paint and other graffiti materials, and to create a record of such sales to help law enforcement AND to slow the incidents of graffiti vandalism." (PortlandOnline.com)
So if you purchase "graffiti materials" you have to print and sign your name and show identification. The laws on who has to track this information however is defined as "any person who owns, conducts, operates, or manages a business where graffiti materials are sold or who sells or offers for sale any graffiti material to store or display, or cause to be stored or displayed graffiti material in an area that is accessible to the public without employee assistance in the regular course of business pending legal sale or other disposition."
The use of business means I can give out graffiti supplies at no cost and not have to track the ID of those who take them. Likewise, as this is a City Code, you can sell and buy without ID outside of the Portland city boundaries.
